Gorilla Glue® Tough Story Official Rules

1. To Enter. During Giveaway Period, visit Tough Story and submit a story. You may also access the Giveaway entry page by clicking on any Tough Team banner, which may be found on various other web sites. Complete the submission form by entering your first and last name, e-mail address, and story.
2. Winner Determination. On or around July 15, 2009, the winning stories will be selected from among all eligible entries received by Sponsor. By participating, entrants accept and agree to abide by and be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all respects. The individuals initially selected as the winners will be notified by e-mail approximately (5) business days after drawing date.
3. Prize/Odds of Winning:

Odds of winning depend on the total number of eligible entries received.
4. Prize Restrictions. All taxes on prize are winner’s sole responsibility; and, Sponsor will notify the Internal Revenue Service and any other applicable governmental bodies of winner’s receipt of prize (and the value of the prize), as required by law. No prize substitution. No prize transfer.
5. Conditions of Participation. By participating, entrant agrees that Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Giveaway or any web site; to be acting in violation of the Official Rules or to be acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Participation in Giveaway is subject to the Promise of Privacy (i.e., the privacy policy) and Disclosures (i.e., the terms of use) of www.gorillatough.com. IF YOU DO NOT AGREE TO THE PROMISE OF PRIVACY AND DISCLOSURES OF WWW.GORILLATOUGH.COM, DO NOT ENTER THE GIVEAWAY, PROVIDE ANY PERSONAL INFORMATION ON THE WEB SITE OR OTHERWISE USE THE WEB SITE. Any activities, determined by Sponsor, in its sole discretion, to be intended to disrupt or interfere with the proper play of the Giveaway, or defraud Sponsor in any way will be prosecuted to the fullest extent of the law in addition to resulting in disqualification from Giveaway.
6. Limitations of Liability: Sponsor’s computer is the official clock for all purposes of Giveaway. Sponsor and its agencies assume no responsibility for (a) any incomplete, incorrect or inaccurate information, whether caused by web site users, tampering, hacking or by any of the equipment or programming associated with or utilized in the Giveaway or by any technical or human error; (b) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of any web site and/or entries; and (c) any problems or technical malfunctions of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, programming or failure of e-mail on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof, or for injury or damage to entrant’s or to any person’s computer (or any information/materials stored therein) related to or resulting from downloading materials from any web site or participating in Giveaway. If, for any reason Sponsor determines in its sole discretion that the Giveaway is not capable of running as originally planned, including without limitation infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which, in Sponsor’s sole discretion, could corrupt or affect the administration, security, fairness, integrity or proper conduct of the Giveaway, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Giveaway. In such event, Sponsor will select the winner in a random drawing comprised of all eligible entries received prior to (and/or after, if appropriate) the action taken by Sponsor or by some other means deemed by Sponsor in its sole discretion to be fair, appropriate and consistent with the spirit of these Official Rules. And, notice of such action will be posted on www.gorillatough.com.
7. DISPUTE RESOLUTION/GOVERNING LAW/WAIVER AND RELEASE, INCLUDING WAIVER OF JURY TRIAL:
Except where prohibited, by participating in the Giveaway: you release and agree to hold harmless Gorilla Glue Company, its affiliates and subsidiaries, promotion marketing/advertising agencies, and the directors, officers, agents, representatives, shareholders, and employees of any of the above organizations from any and all liability arising from participating in the Giveaway, any Giveaway-related activity and/or acceptance, receipt, possession or use/misuse of the prize. To the extent that any such release and hold harmless in (a) is prohibited, you agree that (a) any action at law or in equity arising out of or in any wayrelating to these Official Rules or the rights and obligations of any entrant and/or Gorilla Glue Company, and/or entrant's participation in this Giveaway shall be filed exclusively in the courts of the State of Ohio and you hereby consent and submit to the personal and exclusive jurisdiction of such courts for the purposes of litigating any such action, AND ANY RIGHT TO A TRIAL BY JURY AND A TRIAL BY JURY IS HEREBY WAIVED, (b) any and all disputes, claims, and causes of action arising out of or in any way connected with these Official Rules, the rights and obligations of any entrant or Gorilla Glue Company, and/or entrant's participation in this Giveaway shall be resolved individually, without resort to any form of class action, (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Giveaway but in no event attorneys' fees; and (d) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, exemplary, special, incidental, indirect and consequential damages and any other damages (whether due to negligence or otherwise), other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant and/or Gorilla Glue Company shall be governed by and construed in accordance with the laws of the State of Ohio without giving effect or regard to any principles or doctrines of conflicts of law/choice of law of the State of Ohio or of any other jurisdiction.
